The following policy is a description of the type and management of information PayPAMS may collect from you or that you may provide when you visit the Site and PayPAMS' practices for collecting, using, maintaining, protecting, disclosing and disposing of that information.

At the request of your school system, we have revised our services and this site with an option to allow students over age 13 to view menus and to order meals through this site. Students are not permitted and should not take or try to take any other action whatsoever through this site or our services. Only parents and/or legal guardians should be providing any other information they determine with regard to their student/child. Further school systems and parents and/or legal guardians must provide and document consent before allowing students to access this site and our services to view menus and place meal orders. PayPAMS is expressly relying on such consents, and parents, legal guardians and schools expect and intend for paypams to rely upon such consents.

  • PayPAMS offline or through any other means, including any other website operated by PayPAMS or any third party; or

By accessing this Site, parents and legal guardians expressly consent to and agree to the terms and conditions of this Privacy Policy, including the use and disclosure of your personal information in accordance with this Privacy Policy. If you do not agree with PayPAMS' policies and practices, your choice is not to use the Site.


Glossary of Terms Used

"Authorized End User" or "you" or "your" means any individual 13 years of age and older, authorized, by virtue of such individual's permissions from Customer, and their parent or legal guardian, as applicable, to access the Services. Any individual between the ages of 13 and 17 are not permitted to access the Services unless they have obtained the requisite consent from their parent or legal guardian to access the Services, subject to the Customer's permission to allow a parent or legal guardian to provide such consent.

"Affiliate" means a company owned and/or controlled by PayPAMS.

"Business Partners" means, collectively, third parties with whom we conduct business. Business Partners include your school and/or school district, our website host company, and other third parties that support the operation of our Site and our Applications.

"Cookie" means a small amount of information that a web server sends to your browser that stores information about your account, your preferences, and your use of the Services. Some cookies are temporary, whereas others may be configured to last longer. "Session Cookies" are temporary cookies used for various reasons, such as to manage page views. Your browser usually erases session cookies once you exit your browser. "Persistent Cookies" are more permanent cookies that are stored on your computers or mobile devices even beyond when you exit your browser.

"Customer" or "School" means a school, school district, or organization of schools or school districts for which PayPAMS provides the Services.

"Personal Information" means information about you that specifically identifies you or, when combined with other information we have, can be used to identify you. This includes the following types of information: (1) contact information, including your name, postal addresses, email addresses, telephone numbers, or other addresses at which you are able to receive communications; (2) financial information, including information collected from you as needed to process payments and to administer your participation in the Services. We collect such information as your account or payment, credit or debit card number, expiration date, and card verification number, ACH (bank withdrawal information), if applicable, including bank name, account number and routing number; and (3) demographic information related to billing. For certain Schools, parents and/or legal guardians may also provide the student's (1) first and last names, (2) student identification number (3) school attending and (4) grade. If you are applying for free and reduced meal benefits, the information required for such application and program will be collected, too. This information may include, without limitation, foster status, household members information, last four digits of the applicant's social security number, and such other information required by the program from which you are seeking the information.

"Services" means the payment terminals, websites, mobile applications, or online services owned or operated by PayPAMS and its Affiliates linked to this Privacy Policy. This Site is intended for the exclusive use of adults and children over 13 years of age. PayPAMS does not knowingly collect personal information from children under 13; however, in using the Services, you as the parent or guardian of students under the age of 18, are providing such information about children under the age of 18. In using the Services on behalf of such students, you are representing to us that you are the parent and/or legal guardian of that student(s), with the right to provide such information to us, intending to rely on these representations. If you are under 13, do not use or provide any information on this Site or through any of its features. If PayPAMS learns that it has collected or received personal information from a child under 13 (and not from his/her parent or legal guardian), PayPAMS will delete that information. If you believe PayPAMS might have any information provided by a child under 13, and not from such child's parent or legal guardian, please contact PayPAMS at info@PayPAMS.com. Site visitors may view menus, ingredients, and other such information on the Site. When you visit our Site, data is collected from you, including your IP address. Please also see information below about the use of "cookies" on our Site.

Authorized End Users may not provide any information about a child for whom they are not a parent and/or legal guardian and/or custodian.

BY ACCESSING OR USING THE SITE, AND PROVIDING TO US INFORMATION ABOUT YOU AND/OR YOUR STUDENT, YOU REPRESENT AND WARRANT THAT: I) YOU ARE A U.S. RESIDENT; II) YOU ARE AT LEAST THIRTEEN (13) YEARS OLD AND ANY STUDENT TO WHOM YOU PROVIDE ACCESS TO ENABLE THEM TO VIEW MENUS AND ORDER MEALS ARE AT LEAST THIRTEEN (13) YEARS OLD; AND (III) YOU, AS THE PARENT OR LEGAL GUARDIAN HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY.

Information Being Collected

When you use our Services, we will collect Personal Information needed to register and create your account, to facilitate payment processing, to facilitate your application for meal subsidies and similar programs, and other Services that you may use the Site to access from your School or the subject meal program. Your School may also provide to us certain Personal Information to facilitate your access to and use of the Services. Parents and legal guardians should consult your School's policies in this regard.

Please note that PayPAMS may automatically collect the following information about each visit to the Site:

A. Website Users

  • Details of your visits to the Site, which may include the internet domains or IP addresses from which the Site is accessed, the date and time the site is accessed, the location from which the site is accessed, the pages that are visited, and the address of the web site that linked to the site; and
  • Information about your computer or device used to access the Site and internet connection, which may include the IP address from which the Site is accessed, the operating system and the type of browsers used to access the Site.
PayPAMS may also use "browser Cookies" on the Site, which are small files that are stored by your web browser and on your hard drive. You may refuse to accept browser Cookies by activating the appropriate setting on your browser. The information PayPAMS collects on or through the Site may also include information that you voluntarily submit to PayPAMS, which may include:
  • Information that you provide by filing in forms on the Site, such as by requesting information from the Sales Department or the Technical Support Department or by requesting that members from those departments contact you;

  • Records and copies of your correspondence (including e-mail addresses), if you contact PayPAMS via the Site, e-mail, written correspondence or other means; and

  • Other information received in the course of such communication.

  • If you use the "online chat" feature to contact a PayPAMS representative, you will be prompted to provide your contact information and details of your inquiry for a PayPAMS representative to respond to your inquiry. This feature on our Site is provided through a third party service provider. B. Customers (Schools and School Districts)

  • Account information: What we receive from participating Schools may include, without limitation, pupil records of students and parents of students enrolled in the subject School, such as directory information, email addresses, student IDs, meal account IDs, grade, school, account credentials, courses students are enrolled in, health information kept in student records and meal account benefits eligibility information.

  • We also collect employee account information including user names, email addresses and titles to initially set up products and services for the School.

  • Depending on the School's needs as a customer, the School may also provide to us financial information regarding students and parents of students in order for us to provide services.

THE SCHOOL IS SOLEY RESPONSIBLE FOR SECURING ALL NECESSARY CONSENTS FROM PARENTS, LEGAL GUARDIANS AND CUSTODIANS TO PROVIDE SUCH PERSONAL INFORMATION REGARDING ITS STUDENTS AND HOUSEHOLD MEMBERS. PARENTS AND LEGAL GUARDIANS WHO DO NOT WISH THEIR SCHOOLS TO PROVIDE PERSONAL INFORMATION TO US FOR THE SERVICES ARE DIRECTED TO SO INSTRUCT THEIR SCHOOLS.

C. Parents and Students

As noted above, your School decides how your Personal Information is used and disclosed to us by the School. PayPAMS provides products and services to Authorized End Users of a School (our customers) as a "data processor." The main responsibility of what is known as a "data controller" lies with the School. This also means that the School's own privacy statement governs the use of your and your student's personal information. PayPAMS' Customers determine what information we collect through the PayPAMS products and services and how it is used, and we process that information according to our Customer's instructions and the terms of our contract with our Customer.

This section of our Privacy Statement is provided for informational purposes and describes how parent and student Personal Information is used when PayPAMS products and services are provided through a School. How that information is used depends on the School, so please consult your School's privacy statement.

  • Information We Collect:

  • Personal Information provided to us by a school or school district. The PayPAMS products and services integrate with our Customer's systems. The specific information that is collected from the School depends upon the PayPAMS product or service, but in general, this information includes but is not limited to: name, age, email address, student ID, account credentials, student records, certain health information kept in student records, courses a student is enrolled in when we initially set up the products, fees owed by students, meal account benefits eligibility information, and additional records as requested by the School. Depending on the School's request, we may also collect financial information of students and parents and/or legal guardians of students as is made available to us in order to provide services. PayPAMS will receive regular updated information to keep account information accurate and up to date.

  • Personal Information provided to us directly from an Authorized End User: Depending on the PayPAMS products and services your School uses, we may collect the following data categories directly from you: name, date of birth, grade, email address, student ID, meal account ID, account credentials, student records, certain health records, courses a student is enrolled in when we initially set up the products and services for your School, and additional records as requested by the School. Depending on the School's request, we may also collect financial information of students, parents of students, and household information in order to provide services. PayPAMS will receive regular updated information. Please note, however, that updates may take 1 to 3 business days to be reflected in your account.

  • Personal Information collected indirectly from an Authorized End User: We collect device and usage information when you access and use PayPAMS products and services, including information that your browser or the mobile app sends when you are using it. This data may include your unique device identifier, device information, IP address, your browser type and configuration, the date and time of your use of the product or service, and Cookie data.

  • How We Use This Information

  • On behalf of your school or school district. We use your information on behalf of and under the direction and control of your School, which is the data controller. We use the information in accordance with our agreement with your School to operate, maintain, and provide the features and functionality of the PayPAMS products and services. Your School determines how the Personal Information is used, whether for payment of services, applications for meal programs or otherwise.

  • How We Share This Information
We share student information in accordance with our agreement with your (or your child's) School. Generally, this includes the sharing of such information inside and outside PayPAMS under certain terms. Student information will be accessed inside PayPAMS only by those have a need to know to provide the PayPAMS products and services and improve them. For example, our technical and client support teams may have access to personal information when the PayPAMS products and services are implemented for your School or when software or other changes are required for support and maintenance purposes.

We also share your information with our service providers who facilitate the delivery of the Site and the Services. For example, when you use the "online chat" feature, this service and the "ticket" generated with your request is managed through a third party service provider.

Your School may share your Personal Information with third parties that process, approve and administer meal subsidy programs.

We share your Personal Information relating to payments and payment processing with our third party processors. These third-party processors all maintain security standards and processes consistent with the applicable Industry Data Security Standards.

Use of Information

PayPAMS may use information that PayPAMS collects or that you provide to PayPAMS, including personal information:
  • To present this Site and its contents to you;

  • Facilitate transactions you or your School initiate(s), request(s) or direct(s)request through the Services;

  • Answer your questions and respond to your requests;

  • Communicate and provide additional information that may be of interest to you concerning your chosen Services.

  • Send you reminders, technical notices, updates, security alerts, support and administrative messages, service bulletins, and requested information.

  • Manage our everyday business needs, such as administration of our Services, analytics, fraud prevention, and enforcement of our corporate reporting obligations and Terms of Use (available at https://PayPAMS.com/TermsOfUse), or to comply with applicable state and/or federal law;
  • To gather aggregate statistics regarding users accessing the Site and which pages are being visited;

  • To help PayPAMS improve the Site and make it more useful to PayPAMS' users;

  • To provide you with information, products or services that you request from us;

  • To fulfill any other purpose for which you provide it;

  • To notify you about changes to this Site;

  • In any other way that PayPAMS may describe to you when you provide the information; and

  • For any other purpose with your consent.
Disclosure of Information

PayPAMS may disclose aggregate information about its users which does not identify any specific individual without restriction.

  • To PayPAMS' subsidiaries and affiliates and other websites operated by PayPAMS, its Affiliates and their support departments;

  • To your School and to third party administrators of school meal subsidy programs as your School, you or such program administrator directs;

  • To contractors, service providers and other third parties PayPAMS uses to support its business, as described herein above (for example, to provide the "online chat and email tickets" feature, and for processing of payments);

  • To fulfill the purpose for which you or your School provide it;

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of PayPAMS' assets, whether as a going concern or as a part of bankruptcy, liquidation or similar proceeding, in which personal information held by PayPAMS about its Site users is among the assets transferred;

  • To comply with any court order or other verified request by law enforcement or other government official;

  • To enforce or apply this Site's Terms of Use (available at https://PayPAMS.com/TermsOfUse) and other agreements, including for billing and collection purposes;

  • If PayPAMS believes disclosure is necessary or appropriate to protect the rights, property, or safety of PayPAMS, PayPAMS' customers, you, or any other user of the Site in connection with an investigation of fraud, theft, intellectual property infringement, piracy, or other unlawful activity;

United States Federal and State Education Privacy Laws

PayPAMS, in its role as a vendor to Schools, educational agencies and institutions, both public and private entities ("Educational Agencies"), receives disclosures from the Educational Agencies, which include the Personal Information and other data ("Student Data") contained in student records as well as directly from parents of students. Only information that is needed for PayPAMS to perform services, which are outsourced to PayPAMS by the Educational Agencies, is disclosed to PayPAMS. These disclosures are authorized by the federal Family Educational Rights and Privacy Act (FERPA). PayPAMS considers Student Data to be strictly confidential and does not use Student Data for any purpose other than improving and providing our products and services to the Educational Agencies or on the Educational Agencies' behalf. Our collection, use, and sharing of Student Data is governed by our contracts with the Educational Agencies, the provisions of FERPA, the Children's Online Privacy Protection Act (COPPA), and other applicable state and federal laws and regulations that relate to the collection and use of personal information of students. If you have questions about reviewing, modifying, or deleting personal information of a student, please contact the relevant Educational Agency(ies) directly.

Your California Privacy Rights

This section of the Privacy Policy applies only to consumers who reside in the State of California (as used in this section, "California resident", "consumers" or "you"), and to our processing of personal data of a particular consumer or household ("California Personal Information"), and only to the extent we direct the purposes and means of California Personal Information processing and otherwise qualify as a "business" under the California Consumer Privacy Act of 2018 ("CCPA"). California Personal Information does not include, and this section does not apply to, information that is subject to exemptions or exclusions under the CCPA, including:

  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).

PayPAMS reserves the right to change this Privacy Policy from time to time, and will post any such changes to the Site. Your access or use of the Site after the posting of such changes shall constitute acceptance of those changes.
